AB  - In the Balkan Wars of 1912-13, the Kingdom of Serbia wrested Old Serbia and Macedonia from Ottoman rule. The process of instituting the constitutional order and local government institutions in the liberated and annexed areas was phased: (1) the building of provisional administration on the instructions of government inspectors and the head of the Military Police Department; (2) implementation of the Decree on the Organization of the Liberated Areas of 14 December 1912; and (3) implementation of the Decree on the Organization of the Liberated Areas of 21 August 1913. Finally, under a special royal decree issued in 1913, implementation began of some sections of the Constitution of the Kingdom of Serbia. In late December 1913, the interior minister, Stojan M. Protić, submitted the bill on the Annexation of Old Serbia to the Kingdom of Serbia and its Administration to the Assembly along with the opinion of the State Council. The bill had, however, not been put to the vote by the time the First World War broke out, and the issue lost priority to the new wartime situation until the end of the war.

AB  - In the wake of the Serbo-Turkish wars of 1876-77 and the 1878 Congress of Berlin the process of establishing local government in the newly-liberated areas began. The process of incorporating the so-called New Areas into the legal system of pre-war Serbia took five years (1877-82) and went through four phases. The first phase began with the Second Serbo-Turkish war and lasted to the border demarcation between the principalities of Serbia and Bulgaria in 1878. It was marked by the establishment of provisional local authorities, carried out by the representative of the Serbian government in the Supreme Army Command. In the second phase permanent local institutions were established in the New Areas in order to harmonize their administrative and judicial structure with that of pre-war Serbia. In the third phase the agrarian reform was carried out in order to abolish feudal relations, while protecting the property rights of the former Muslim land­owners in compliance with Article 39 of the Berlin Treaty. In the fourth phase the question of resettling the "New Serbian Areas" was being resolved after the significant population change brought about by the Second Serbo-Turkish War. The focus of the paper is on the first two phases.

AB  - This scholarly work treats only the legal structure of households in Serbia and Bulgaria in the 19th century. The author's intention is to describe and present similarities and differences between the most important household's structural elements (Household Council, Household Head, Household Woman and Household Members), their relationships and status in the Ottoman legal-political order.
AB  - Osnovni oblik patrijarhalne kulture u većini balkanskih zemalja u XIX veku bila je porodična zadruga sa inokosnim porodicama. U to vreme, ona se razvila sa svim elementima jedne jasno profilisane pravne i socijalne institucije. Zahvaljujući svojoj kompleksnoj prirodi, porodična zadruga je često bila predmet interesovanja i naučne analize brojnih istraživača u XIX i XX veku. Pravnici, istoričari, sociolozi, etnolozi, antropolozi, političari, pa čak i književnici iz balkanskih ali i zapadnih zemalja, pisali su o porodičnoj zadruzi u balkanskim zemljama iz ugla svoje naučne discipline, primenjujući raznovrsne metodološke postupke u analizi njenih strukturalnih elemenata. Postoje različite, zapravo oprečne teorije o poreklu i suštini porodičnih zadruga (o antropološkim, kulturnim, klimatsko-geografskim, socijalno-ekonomskim i pravno-političkim pretpostavkama njihovog nastanka) njihovoj evoluciji i istorijskoj eroziji. Ovaj rad proučava jedno vrlo značajno pitanje u vezi sa istorijskim razvojem porodičnih zadruga u Srbiji i Bugarskoj u XIX veku. Reč je o unutrašnjoj strukturi ove institucije kao pravne ličnosti: njeni strukturalni elementi i međusobni odnosi. Drugim rečima, ovaj članak analizira samo porodično-pravne odnose unutar zadruge, i to isključivo one sa naglašenim javno-pravnim elementom. Privatno-pravni odnosi, tj. svojinski, obligacioni i nasledni odnosi kao i pitanje deobe zadruge nisu analizirani zato što oni imaju poseban značaj i zbog toga zaslužuju da budu predmet pažnje posebne naučne obrade. U vezi s tim, ovaj rad posvećuje pažnju najvažnijim organima i elementima porodičnih zadruga (kućni savet, domaćin, domaćica, zadrugari), njihovim najvažnijim osobinama koje ih čine specifičnim u odnosu na druge ustanove patrijarhalne kulture na Balkanu.

Pravnici, istoričari, sociolozi, etnolozi, antropolozi, političari, pa čak i književnici iz balkanskih ali i zapadnih zemalja, pisali su o porodičnoj zadruzi u balkanskim zemljama iz ugla svoje naučne discipline, primenjujući raznovrsne metodološke postupke u analizi njenih strukturalnih elemenata. Postoje različite, zapravo oprečne teorije o poreklu i suštini porodičnih zadruga (o antropološkim, kulturnim, klimatsko-geografskim, socijalno-ekonomskim i pravno-političkim pretpostavkama njihovog nastanka) njihovoj evoluciji i istorijskoj eroziji. Ovaj rad proučava jedno vrlo značajno pitanje u vezi sa istorijskim razvojem porodičnih zadruga u Srbiji i Bugarskoj u XIX veku. Reč je o unutrašnjoj strukturi ove institucije kao pravne ličnosti: njeni strukturalni elementi i međusobni odnosi. Drugim rečima, ovaj članak analizira samo porodično-pravne odnose unutar zadruge, i to isključivo one sa naglašenim javno-pravnim elementom. Privatno-pravni odnosi, tj. svojinski, obligacioni i nasledni odnosi kao i pitanje deobe zadruge nisu analizirani zato što oni imaju poseban značaj i zbog toga zaslužuju da budu predmet pažnje posebne naučne obrade. U vezi s tim, ovaj rad posvećuje pažnju najvažnijim organima i elementima porodičnih zadruga (kućni savet, domaćin, domaćica, zadrugari), njihovim najvažnijim osobinama koje ih čine specifičnim u odnosu na druge ustanove patrijarhalne kulture na Balkanu.",
