Основно питање на које је тражен одговор у овом раду односи се на утврђивање да ли се може говорити о интересу детета да се о њему
старају два родитеља и да ли породично право води рачуна о том интересу.
Интерес детета да има два родитеља се посматра у различитим породичноправним ситуацијама, као што су природно рођење, усвојење и зачеће применом артифицијелних репродуктивних технологија. У случајевима природног рођења и усвојења ради се о већ рођеном детету, док се у случају рођења
детета применом артифицијелних репродуктивних технологија ради о потенцијалном, односно, будућем детету, што ову ситуацију разликује од претходних. У раду је коришћен упоредноправни метод, анализирају се решења
Конвенције о правима детета и права европских земаља.
In this paper the main issue is to explore if there is an interest of a child
to have two parents and if Family law considers this interest or not. An interest
of a child to have to parents has been examined in the different family situation:
natural birth (in marriage, out of wedlock and after the divorce), adoption and
conception using artificial reproduction technologies (ART). In the situations of
natural birth and adoption the child was born already, however in the situation
of the child’s conception using artificial reproduction technologies it can be said
the child is potential or future one. The author concludes that Family law does
consider an interest of a child to have two parents, not explicitly but adopting
different solutions which identify and meet this interest.
One is the possibility of joint parental responsibility after the divorce,
different solutions for establishing parentage for the child born out of wedlock,
priority of the spouses or partners as ad...opters. If the child was born using ART
these solutions are: supportive parenting if the woman without partner is subject
of ART (UK solution), right of a child to know the donor’s identity, maintenance
obligation of the grandparents (German’s clinics solution).
The author uses comparative perspective, analyzing the Convention of the
rights of the child, Family laws of the European countries and USA.
