Правноисторијски прилог истраживању функције претора у Византији
A Legal-Historical Contribution to the Research of the Office of Praetor in Byzantium
Апстракт
Као и у бројним другим случајевима, функција претора у Византији је заснована на старини, коју је цар Јустинијан I оживео у току средњих година владавине. У раду је хронолошки изложена историја функције и анализирана улога претора у судском и управном систему. Најпре се испитује делокруг преторових послова до X века, што је период у којем су изворни подаци малобројни. Током X века претором се назива тематски судија, највиши цивилни чиновник у провинцији, чија власт јача како он надилази стратега, дотадашњег тематског управника. Током XI и XII века расте број функционера преторa, добро заступљених у сигилиографској, документарној и епистолографској грађи. На основу појединачних случајева испитују се преторове компетенције правосудног органа. Истовремено, у престоничком правосуђу такође делује претор, чије ингеренције можда обухватају и поље приватног права. Последњи подаци о претору, на крају постојања Царства, приказују дворског званичника задуженог за контакте са латинским светом.
Emperor Justinian I appointed new heads of civil and military command in the provinces, named after yet another Roman magistrate, a vestige of classical antiquity. The Praetor Justinianus is the subject of Justinian’s Novellae 24, 25, 26, 29, and 74 (104). His judicial competencies included jurisdiction in criminal and civil proceedings and appellate jurisdiction in lower-value litigations (up to 500 solidi) on behalf of the Emperor. The main duties of this functionary also included crime control and maintining law and order. However, the broad judicial authority of Justinian’s praetores was obviously limited, as the central government appointed and controlled them through the capital’s appellate bodies of quaesitor and prefect. Justinian’s office of praetor appears to have been short-lived: such a conclusion is based not only on the fact that there are just two surviving seals from the 6th and 7th centuries but also on a few reports from Thrace, which testify that, in the mid-6th cent...ury, vicarii, the functionaries abolished by the appointment of the praetor, were selected again. It is unclear whether other provinces appointed the praetor Justinianus: Paphlagonia, Pisidia, Lykaonia and Sicily. However, some studies that drew on Latin and Greek sources understood the first strategoi in these regions as direct successors to the praetores. Concurrently with appointing praetores throughout the Empire, Emperor Justinian I created a new function of the same name in the capital, also engaged in the judiciary and punishment. This office also seems to have become obsolete after the 6th century.
